MINUTES OF THE MEETING

OF THE ALLAMAKEE COUNTY

PLANNING AND ZONING COMMISSION

December 19, 2011

Board of Supervisors’ Room, Courthouse, Waukon, Iowa

Meeting was called to order at 6:00 P. M. by Chairperson John Smola

 Planning and Zoning Staff present: Tom Blake, Zoning Administrator.  See attendance sheet for public and others in attendance.  All Board members voting “AYE” unless noted. MCU means Motion Carried Unanimously.

 Approval of Agenda: Cahoon made a motion to approve the agenda. Pladsen seconded. MCU.

Approval of Minutes: Everman made a motion to approve the minutes of November 21, 2011. Pladsen seconded. MCU.   Cahoon made a motion to approve the minutes of November 23, 2011. Leppert seconded. MCU.

Public Comment: None

Public Hearings: None

Old Business:

Cluster Development Ordinance-Smola presented some information regarding the status of his work on this subject.  Discussion was held regarding what other cities/counties had regarding Cluster developments.  Board directed Blake to send them copies of what other counties had in their ordinances.

New Business:

Agricultural Legend use restriction discussion and removal requests.  The frequent use of, and now the removal requests, the Ag Legend on subdivision plats was discussed.  Several owners are now asking that the use restriction be removed to allow for all uses in conformity with the Zoning and Subdivision Ordinance. 

bulletDougherty, Brian, Scott, John and Rita—Leppert made a motion to approve removing the agricultural legend restriction from the recorded plat for Lot 2 of Lot 1 and Lot 2, NW ¼ NW ¼, Section 4, T97N, R5W upon the condition that Lot 1 of 1, Lot 2 of 1 and Lot 2 be considered and used as one parcel.  Pladsen seconded. MCU.
bulletBulman, Margaret and Loren—Everman made a motion to approve removing the agricultural legend restriction from the recorded plat for Lot 1 of Lot 2, NW ¼ NW ¼, Section 4, and Lot 4, NE ¼ NE ¼, Section 5, all in T99N, R5W. Cahoon seconded. MCU.
bulletReinke, Robert and Sandra (Current owner, Matt Phillips)—Pladsen made a motion to approve removing the agricultural legend restriction from the recorded plat at Book Z Page 98-105 for Lots 1 of 1, 2 of 1, 3 and Lot 4 of Government Lot 2; Lots 5 and 6, Government Lot 3, Section 21, T100N, R4W. Everman Seconded. MCU.
bulletZoll Revocable Trust, Raymond and Rose Rita( Current Owner, Allamakee County Conservation)—Pladsen made a motion to approve removing the agricultural legend restriction from the recorded plat for Lot 1 of Lot 2 in NE ¼ NE ¼ in Section 29 and Lot 1 in NW ¼ NW ¼ in Section 28, all in T100N, R4W recorded at Book Z Page 453-461 and Book A-1 Page 359-360 upon the condition that it remain as one parcel. Cahoon seconded. MCU.

Meeting time: Discussion was held regarding the meeting times.  Consensus to leave at 6:00 PM for consistency and convenience.

 Calvin and Kathleen Snitker Subdivision Plat—Cahoon made a motion to approve the plat of Lot 1 in NW ¼ NE ¼, Section 26, T98N, R6W.  Everman seconded.  MCU.

 

Pladsen made a motion to adjourn.  Everman seconded. MCU.
